Interesting. I am not a lawyer but just a regular web user. I am used to have everything in the top menu, and I bet most others are too.

Also, if the TOS are so very essential, then they should be at an essential place: In the top menu. All the other stuff is there:

naaaah......rarely comes up. we all hope it's never relevant to activity. and are on the honor system.....

when we need it we trot it out. better it's not in our faces.

But then, if it's not visible, the owners and moderators shouldn't complain if nobody reads the TOS. Righteously waving it in front of our faces when they deem it appropriate doesn't cut when all the time they hide it from view.

Maybe we should have an anonymous poll here who has read the TOS and who hasn't. I bet it will turn out something like 90 %/10 % in favor of those who haven't.

Al, when you and anyone else signed up to WBF you had to confirm that you read the TOS. It is part of the process. I get that many people don’t/haven’t read it but is it fair to point the finger at WBF’s admins if one didn’t?

I obviously have read them since I am a moderator but I don’t think there is anything crazy there and different than any other forum.
 
Here’s something that solves the problem. TheTOS are in the very forum all of you are posting in right now . You can find the thread but not the TOS.
The title of this forum is now appropriately named. Everyone who registers is told not to post until you read the TOS so now to say you never read it because you can’t find it …………I will say again that our TOS were drafted by 3 lawyers and have been in the same place since the forum launched. They are not hidden in a link at the bottom of the forum land page but rather in the very first subforum at the top

The thread "* TERMS OF SERVICE - ALL MEMBERS TO READ BEFORE POSTING ANY CONTENT *" is not at the top, but at the bottom of sticky threads in "Announcements, Suggestion Box and Terms Of Service".

The first thread under sticky threads is "A Special Announcement From Your Admin Team", the TOS thread is thread #12 from the top, at least on both my computer and my phone. You have to scroll down to see it, so it's still hard to find.

When you register, is there a link to the TOS on the registering page? I don't remember having seen one.
 
I truly am baffled at the suggestion that the Terms of Service here are "hidden." The Terms of Service are basically the only thing I can find.

On my iPhone, I can scroll down on, I think, literally every forum page, and find the Terms of Service.

Unfortunately when a thread is stuck it goes by the date and the TOS were the first stuck thread dating to 2010 and there is no way that I can find to get it to the top unless a post is made. We will try that

Having. said that IF alll of you were to back out of this thread and into the subforum showing all of the threads, the TOS are sitting immediately above this thread and yet everyone says they are hidden. Sorry but on the day EVERYONE registered in order to become a registered member EVERYONE must acknowledge that they have read the TOS and they are not to post until they do so. Dminches was IMHO correct when he said "it's on you" if you haven't. Our TOS have been reviewed on 3 separate occasions by 3 different lawyers so I feel very comfortable with them. The TOS is the "constitution" for WBF and every moderated member or post is triggered when a post is reported. If there are no violations of the TOS the member who reported it is advised of such. So also is notification given to the member who reports a post what the disposition of the report was. Bottom line is that the inference is simple.....as registered members having filled out the same registration form as close to 30,000 other people, the assumption is that everyone has read the TOS. To decry otherwise has no validity.

I almost never scroll down completely on any web page. There is no reason to.

Whatever important there is should be at the top.

If you want compliance, Steve, you need to make it easy for the TOS to be found.

The only thing that I knew about the TOS is that discussions about religion and politics are not allowed, since we have been constantly made aware of that fact during moderation. It's a good policy by the way, I have to admit.

For you to say what you have falls on these deaf ears.I would assume by now that you have found them and as I stated they are sitting directly above this very thread in which you are posting.

Steve, have the TOS ever been modified or changed? I am told they were once different. If so, I am sure there is language somewhere saying they can change without notice or consent. When I first joined, I think it was indeed possible to delete past posts. Now it is not. Can you clarify?

My 11 year old godson knows his way around on computers much more easily than I do, and probably much more easily than most members as well. That comes with how you grow up with computers. It's a non-argument, in my view.

That's unfortunate. Well, at least now I know where the TOS are.
 
I have read the TOS and am not claiming they are hidden. I just think people should be aware of the implications especially about the ownership of content.

I am also still looking for clarification about #1 which states WBF does not control what people post. I am concerned they have and can and I gave a specific example.

There has been no language changed. The TOS were reviewed on 3 separate occasions by lawyers. The only things added many years ago was article 11 which is related to copyright as we had nothing in our TOS to address that and several years ago we added Article 20 which pertains to manufacturers , dealers and distributors . Short of that there are no changes

Really, Ron? The only thing that constantly stares in my face each and every time I open WBF is the top bar, with "New Posts / Latest Activity" and so on, and above it "Videos / Forums / Promoted Threads" etc.

It's called scrolling Al ;) As I said my 9yo grandson found the TOS in under a minute
