Obama does have eleven more months before his term is over. It's not like he's out next week.

Any new appointee must go through the approval process in Congress, so there is a system of checks and balances in place. It's been said that Obama may try to appoint a new justice during a break in Congressional session, in which case the appointment is not permanent. It lasts until the end of the next session, ending either in ratification of the appointee or their dismissal. This is how I understand this to work, obviously open to clarification from anyone familiar with these processes.

Obama has done no favors for Republicans. I don't see them doing him any either, especially if he appoints a liberal leaning judge. All bets pointing to the next Prez to make the appointment.

First of All God Bless Scalia. May he rest in peace. I think the Republicans are in denial. If the Democrats have any b---s at all they will push their nominee. In the last eelction voter participation was a huge problem.Obama said 2 out of 3 did not vote.ANy attempt to block a nominee will result in a huge turnout for Democratic voters.

It is amusing that New York Senator and Senate Majority Leader-in-Waiting Charles Schumer gave the Republicans cover for the view that confirmation of a new Supreme Court Justice should await the next President.

In July 2007 the New York Democrat gave a speech to a progressive legal society in which he said this about confirming a George W. Bush nominee in the last 18 months of his Presidency as recounted in Politico:

“‘We should reverse the presumption of confirmation,’ Schumer told the American Constitution Society convention in Washington. ‘The Supreme Court is dangerously out of balance. We cannot afford to see Justice [John Paul] Stevens replaced by another [Chief Justice John] Roberts, or Justice [Ruth Bader] Ginsburg by another [Samuel] Alito.’”

Mr. Schumer went on to say that he would recommend to his Senate colleagues “that we should not confirm any Bush nominee to the Supreme Court except in extraordinary circumstances.”

I don't think people relize what a big deal this is, As much as anything conservatives have utilized the SUprem Court to facilitate there power grab.
The court has ruled in their favor on Camapign financing.
Basically approving the use of unlited amounts of money by unknown contributors..
Gerrymandering of Congressinal districts. Giving themselves undefeatable seats in the Hiuse of Representatives.
Gutting the Voting Rights Act
Approving Voter ID laws.
Limiting the the use and collection of union dues.
Those are just a few.
Who knows whether these laws will be revered. At least for the moment the jugernaut is stalled.

Not to mention throwing G.W. the (most disastrous) presidency (in living history), which gave us the Iraq debacle.

Yup, the campaign finance laws the SCOTUS approved are disgusting. I am empathetic for Scalia's family and friends but I thank god he's gone. Citizens United was irresponsible and an obviously bad decision.

The GOP is rupturing and their fear-based policies are being dragged into the light. The support for Trump is embarrassing, it's sad that many people support such a disgusting person... he stands for and campaigns on fear and hate.

My guess is people aren't going to put up with the GOP's current obstructionist tactics for much longer and soon the GOP will be a memory. IMO, the way they have approached their job in the Legislative branch is approaching treason.

Now that i have given this some thought I woullld not object to the appointent of a true moderate to act as a swing vote. My heart yearns for the appointment of a liberal equilvalent to the radical judge Roberts, I realize there is never going to be another Earl Warren. What passes as a moderate today would be a radcial conservative in my day. Beleive it or not I am not that concerned about social issues. Finance is the big thing.

I have to agree with this before the thread is locked. Great post.

I miss the grand old party of Eisenhower, and even Reagan (I'll skip over Nixon if you don't mind). They were worthy opponents. They were good to have around, to provide gravity at the center right. But they were killed by their own disturbed, petulant children, and this is what remains. It's very sad.

The country has been on a downward slide since the conservative shift to the panel of nine. IMO, of course.

I agree.

We need to bring prosperity back to the middle class and eliminate poverty. Close tax loopholes for the wealthy and large corporations. Return jobs to the USA that have been moved overseas or to Mexico.

Other things are important but the financial issues are key. I don't see any candidate as willing to address these issues except for Bernie.

judge judy?? she can make the step up!

i agree dave though to do as you suggest will need the emergence of genuine wage inflation... one could argue the middle class is a post war illusion and recent events are more of a correction and reality than some kind of temporary affliction.

you cant really pay more if your not selling for more or making for cheaper, commodity prices have fallen through the floor, this should mean its cheaper to build things and allow some wage inflation..

whats really needed is a reason to be optimistic, after all that's what all the nonsense boils down too. i don't see any.

china been driving global growth and has warped the commodity markets, its like a fat guy now that's lost loads of weight, the excess skin is now more of a problem. china is in more trouble than we think, its all coming to a halt again in terms of finance.

you give the middle class more money all they will do is spend it, great in the short term but the resulting mini consumer boom just hides the real problems all the while personal debt increases. this is the story of the last 7 years.. false dawns, reality is yet to show its self.

going to be ugly!

trumps just the start.

This is a pipedream. These jobs won't be coming back, nor should they. The "work" may come back, but not the "jobs" once associated with doing the work. Only way manufacturers will bring back work is if it can be done at lower cost domestically, which is highly capital / technology intensive, requiring a fraction of the labor it took to do the work it was first moved offshore.
