There's a program out there that only just now came to my attention, and it's callled RIP THAT MUSIC. It pretends to be a LEGAL program for ripping the soundtrack off of any youtube video. I'm not sure I buy it, and I would love to hear your opinions on this software.

It should be noted I have no interest myself in this, but I'm having (or trying to have) a discussion with others on a different forum that I view this as piracy. What say you?

There are a lot of tools like that. They install a fake audio driver between Windows and the real driver and save the stream. This one recompresses into MP3 so you take a double quality hit.

Is it a form of piracy? Let's start at the top. Unless the original music video was uploaded by the label, the source on Youtube itself is pirated! Then when you save it, you are pirating it again. If the label put it up there, their intention is for you to stream it and if you want to keep it, pay for it. So saving it is also piracy.

I am not an attorney so please do not take this as a legal opinion. The program is saving a stream from an unprotected video. So it is not violating DMCA. In that sense, I would say the program is "legal" but its use might not be.
